Apple sued for renting HD movies to non-HD devices

A Florida lawyer has started a class action lawsuit against Apple, accusing them of misleading customers to pay for HD content they could not use.

In 2010 the plaintiff downloaded a copy of the Adam Sandler movie ‘Big Daddy’, selecting the HD version as this was the default option presented, unaware that his model of iPhone was unable to show the film in high definition.

The HD option only became the default for movies in 2010 with the release of iTunes 8, potentially leading many customers who would still have been using the iPhone 3G to inadvertently pay extra for HD content they could make the most of on their device.

Apple has since added a disclaimer to their website advising users of the potential problem but the lawsuit is seeking financial compensation for what they consider unjust charges to customers Apple knew could not use the content.
